Border Communities Oppose REAL ID Act

What:Press Conference to demand that Senator Feinstein hear the voices of border communities regarding the REAL ID Act – a controversial piece of anti-immigrant legislation currently pending in Congress.
Who:American Friends Service Committee, Environmental Health Coalition, Southwest Wetlands Interpretive Association, ORGANIC Collective, San Diego BayKeeper, and San Diego Audubon Society.

Why:To draw attention to the potential impact of the REAL ID Act.

If passed, the REAL ID Act will:

Force immigrant communities further undergroundand accelerate the growing black market in documents, thereby making it easier for terrorists and other criminals to operate.
Undermine America’s moral authorityby turning away legitimate asylum seekers fleeing tyranny and making it harder to overturn illegal decisions by immigration authorities.
Waste valuable resourceson a few miles of border fences when we all know that all of the fences in the world won’t protect us if we don’t get serious about reforming our broken immigration system.

Degrade our natural environmentby allowing unnecessarily destructive border projects to ignore federal, state, and local regulations that are meant to protect wildlife, wetlands, clean water, clean air, safety, historic sites, and human health.

REAL ID bypassed normal committee procedures and quickly passed the House of Representatives as a stand-alone bill and was sent to the Senate on February 14th. Now attached to the Iraq and Tsunami Relief Supplemental Appropriations Bill (H.R. 1268), REAL ID appears to be on a fast track to becoming law. Many civil, human and immigrants’ rights organizations are voicing grave concerns that provisions contained in REAL ID will undermine the fundamental rule of law, while trampling on the rights of hardworking immigrants and refugees fleeing persecution.

The REAL ID Act and The Triple Fence

Recently, the California Coastal Commission rejected a proposal by the Department of Homeland Security to construct the last 5 miles of the Triple Border Fence in San Diego. The Coastal Commission stated that the construction of this fence would destroy miles of sensitive wetlands, home to numerous endangered plant and animal species. HR 418 would allow the Triple Border Fence to be built in San Diego, despite the 100 meter by 5 mile, highway sized swath of environmental destruction it would cause. In addition, this would only cause more migrant people to be forced to cross in the desert, resulting in more deaths. Already over 3,200 migrants have died crossing the US/Mexico border since operation Gatekeeper began in 1994.

o It will not make us safer, but rather drives people further
into the shadows of our communities, undermines our
tradition as a beacon of hope for refugees and asylees and
places outrageous unfunded mandates on states.
o The intelligence reform bill that just passed last December
included immigration provisions such as federal standards on
driver’s licenses and IDs. The REAL ID Act repeals those
provisions before they can even be implemented.
o An appropriations bill should not be used as a vehicle to
attach controversial legislation that has not gone through
the normal committee process where it can be considered on
its merits;

o Our immigration system needs to be reformed, but the REAL
ID Act is not the answer. Please focus on *real *reform, not band

*BACKGROUND*

The House passed a bill that will provide additional money for the war
in Iraq, for military operations in Afghanistan, and for tsunami
relief. As expected, James Sensenbrenner’s (R-WI) REAL ID Act has been
attached to that bill.

The REAL ID would among other things:

* keep licenses from members of our communities;
* make gaining asylum harder for real refugees
* limit a person’s access to federal courts;
* Waive /all/ laws (environmental, federal, and state) in order to
build a wall on the U.S. border.

Now the Senate needs to pass an appropriations bill. It has the choice
to either take up the House bill (which includes REAL ID Act) or
consider its own bill. In either case the Senate will have to deal with
the REAL ID Act on the floor _or_ during conference committee with the
House.

The REAL ID Act is misguided legislation that will only hurt our
communities; we need to send a strong message to the Senate that it
should not be considered as part of the appropriations bill (or ever).

BORDER FENCE ACTION ALERT!

WHAT:


Contact Senator Feinstein and urge her to request the U.S. Senate to hold hearings and use the committee process in considering H.R. 418 (REAL ID Act). Urge the Senate to NOT fast track this devastating bill (like the House did), but to require it to go through the regular committee hearing process. Senator Feinstein is in a position to protect our democracy; let's encourage her to put an end to this undemocratic process.

REAL ID would:


ü Give the Secretary of Homeland Security the authority to waive ALL LAWS in order to quickly construct barriers and roads at US borders, including completing the Triple Fence in San Diego.


Under REAL ID, the Secretary of Homeland Security would have the sweeping and absolute authority to waive all federal, state, and local laws - including environmental, labor, civil, and criminal laws, and laws governing the rights of Native American nations - in order to construct barriers and roads along US borders. The decision to waive these laws would not be reviewable by any court or administrative body even if it causes harm to individuals, the environment, etc.


ü Prevent vulnerable asylum seekers fleeing persecution from obtaining safe haven in the US.


REAL ID would endanger individuals seeking protection from persecution, a fundamental commitment from which the US has rarely strayed. US federal courts would be prevented from stopping the deportation of individuals back to the countries where they were persecuted, and persons fleeing persecution would be required to submit unreasonable evidence in order to win asylum, a requirement that will surely place safety out of reach for those who need it most.


ü Provide civilian bail bondsmen the unprecedented authority to arrest and detain non-citizens who have been ordered deported, imposing vigilante justice on those who are awaiting their day in court.


Civilian bail bondsmen and "bounty hunters" would be given the authority to arrest, detain, and turn immigrants over to the Department of Homeland Security. This provision represents an unprecedented grant of authority over basic liberty decisions to the private sector and a frightening abdication of government responsibility. Civilian bail bondsmen are not subject to the same due process constraints as other law enforcement officials, and it is unclear what recourse, if any, would be available to people whose rights are violated, including cases of mistaken identity.


ü Unwisely force state motor vehicle departments to interpret and enforce complex immigration laws, undermining public safety and driving hardworking undocumented immigrants further underground.


REAL ID would institute a multi-tiered system for driver’s licenses and ID cards for US citizens and legal immigrants, while states would be forced to deny licenses to undocumented immigrants. State motor vehicle agencies would be charged with the impossible task of interpreting complex federal immigration laws in order to issue driver’s licenses. Under REAL ID, legal immigrants’ driver’s licenses would expire with their immigration documents, but this requirement reflects a misunderstanding of the immigration system-visas and immigration statuses do not have uniform documentation, nor do they have simple expiration dates. Many non-citizens are still lawfully in the country even though their immigration document may have expired. REAL ID’s proposed multi-tiered driver’s license system will likely result in increased discrimination and civil rights abuses.


These complex issues need to be debated more fully. Such drastic changes should not be passed without hearings or simply attached to other critical legislation. The "REAL ID Act" moved very quickly through the House of Representatives without the benefit of adequate debate, study, and hearings in the relevant committees and without adequate debate on the House floor. Changes were made to the language hours before the vote on the floor and members did not have a chance to read the final bill before passage. We must ensure that this does not happen in the Senate as well.

ACCIÓN URGENTE CONTRA EL REAL ID


¿QUÉ NECESITAMOS?


Que contacten a la Senadora Feinstein y exigirle que presione al Senado para que este lleve a cabo audiencias e imponga el proceso legislativo ordinario por medio de los comités a la iniciativa de ley H.R. 418 (también conocida como el Acta del REAL ID). Exhortarle al Senado de NO tomar las mismas medidas que tomó la Cámara Baja cuando los representantes federales le aplicaron la vía rápida (fastrack) al REAL ID, el Senado debe de sostener audiencias tal y como lo establece el proceso legislativo. La Senadora Feinstein tiene la obligación de hacer respetar el proceso legislativo, hay que pedirle que se pronuncie contra este proceso anti-democrático.


DE APROBARSE, EL REAL ID PERMITIRÁ:


· Otorgarle al Departamento de Seguridad Nacional (DHS por sus siglas en inglés) la autoridad de no acatar NINGUNA LEY con el objetivo de permitir la rápida construcción de muros y caminos para facilitar el patrullaje en las franjas fronterizas, incluyendo la expansión del Triple Muro en el área de San Diego.


De acuerdo con el REAL ID, de convertirse en Ley pondría al DHS por encima de la Ley, al entregarle el poder absoluto y sin precedente de no acatar las leyes federales, estatales y municipales, incluyendo Leyes de carácter ecológico, laboral, civil y penal, al igual que las Leyes estipuladas para salvaguardar los Derechos de los Pueblos Indígenas- con el objetivo de facilitar la construcción de muros y caminos en la franja fronteriza. La decisión de no acatar las leyes federales, estatales y municipales no podrá ser revertida por las cortes y tampoco será sujeta a un revisión administrativa, aún si el accionar del DHS causa daños y prejuicios a habitantes, comunidades, el medio ambiente, etc.


· Complicar el proceso de asilo político en para quienes huyen de la persecución y buscan refugiarse en los Estados Unidos.


El REAL ID pondrá candados al proceso de asilo político para quienes buscan refugiarse de la persecución, un compromiso que los Estados Unidos ha mantenido siempre. Las Cortes Federales de los Estados Unidos no podrán intervenir en el proceso de deportación de un refugiado político, si este es repatriado a un país donde fue perseguido(a). En ese sentido, a las personas que huyen de la persecución se les obligará que presenten documentación y evidencia adicional a la que ya estipula la ley para obtener asilo, dicha situación pondrá en peligro la integridad física de quienes necesitan más apoyo.


· Otorgarle la autoridad sin precedente a ‘Caza Recompensas’ civiles (bail bondsmen) de poder detener y arrestar a migrantes que han pasado por un proceso de deportación. Se trataría entonces de la imposición de un sistema extra-judicial para quienes buscan resolver su estancia en el país por medio de las cortes.


Los caza recompensas civiles recibirán la autoridad de detener, arrestar y turnar a migrantes al Departamento de Seguridad Nacional. Esta modificación a la Ley implica un temible cambio sin precedente de traspasó de la autoridad federal al sector privado. Los caza recompensas civiles no están obligados a respetar los linimientos que rigen a las autoridades policíacas en el país. En ese sentido, no queda claro si habrá mecanismo de denuncia en caso de violaciones a los derechos civiles y humanos de detenidos.


· Impondrá a los Departamentos de Vehículos Motorizados de los estados la obligación interpretar y aplicar las complejas leyes migratorias del país. Esto provocaría incrementar los riesgos de la seguridad pública y restaría los derechos de las comunidades migrantes.


El REAL ID establecerá un sistema complejo para la obtención de licencias de conducir y de credenciales de identidad para ciudadanos y migrantes documentados y obligaría a los estados a no proporcionar licencias de conducir a migrantes indocumentados. Los Departamentos de Vehículos Motorizados estatales estarán obligados a desempeñar la imposible tarea de interpretar el complejo sistema de leyes migratorias para poder emitir licencias de conducir. Bajo el REAL ID, las licencias de conducir emitidas a los migrantes documentados perderán validez cuando expiren sus documentos migratorios, pero este requisito ejemplifica un profundo desconocimiento de las leyes migratorias-las visas y demás documentos migratorios no están sujetos a un proceso uniforme y estos mucho menos cuentan con un sistema de vencimiento sencillo. Muchos migrantes pueden aún permanecer de forma documentada en el país, aún cuando sus documentos se hayan vencido. La propuesta del REAL ID para la obtención de licencias para conducir sin duda incrementará la discriminación y provocará violaciones a los derechos civiles.



Este tema tan complejo tiene que ser debatido. Los cambios drásticos propuestos por REAL ID no deben ser aprobados por los senadores sin antes no sostener audiencias. El REAL ID pasó por un proceso por demás rápido en la Cámara de Representantes, sin que se haya sostenido debates, estudios y audiencias donde las comunidades impactadas pudieran haber presentado sus inquietudes, lo que es aún más preocupante es que el pleno de la Cámara de Representantes no debatió seriamente la iniciativa. Se modificó la iniciativa de ley, horas antes de que REAL ID pasara a votación, sin darle oportunidad a los representantes de leer detalladamente la iniciativa antes de que fuese aprobada. El Senado tiene la obligación de no repetir el mismo error que la Cámara Baja.
