On August 2, 2005, Nicole Fink, a local animal rights activist invoked her First Amendment right to freedom of association by refusing to testify before a federal grand jury. She is scheduled to appear before a judge on Wednesday, August 17 at 10:00 a.m. to hear the outcome of civil contempt charges, and it is likely that she will be jailed that day.

Judge Irma Gonzalez refused a request this morning in Federal Court to grant bail for David Agranoff and Danae Kelley. The two were once again taken into custody. Both were angry, but in good spirits, knowing that they are doing right by all oppressed people.

We just got word that the appellate court granted bail for David and Danae pending the outcome of an appeal that was filed in response to their imprisonment. There will be a hearing at 3:30pm today (Friday) in the courtroom of Judge Gonzalez 880 Front St. 4th floor division one. This hearing will set the conditions of their bail. They could be released on bail as early as today! Please come to the hearing today to support David and Danae!

Pack The Courthouse Tomorrow to Free David and Danae!

Instead of holding our standard demo on Tuesday, a support rally will be held at the Federal Building (880 Front Street & Broadway) for David and Danae this Thursday at 2:30pm. A press conference will be held at 3:00pm. Please arrive on time! We are asking people to pack the courtroom for their hearing immediately following the rally and press conference. Please bring signs, noisemakers and friends for the rally!

On Tuesday, July 12th, David Agranoff and Danae Kelley were arrested for civil contempt for refusing to cooperate with the grand jury. Of all eight people known to have appeared before the grand jury, only these two refused to testify on the grounds of First Amendment objections. This Thursday, Judge Irma Gonzalez has agreed to hear a motion brought by their attorneys to release them. David and Danae can only be kept in prison as long as their imprisonment is believed to serve coercive and not punitive purposes. As soon as Judge Gonzalez believes that no amount of time in prison will coerce them into testifying, by law she must release them. David and Danae will be presenting that argument in court on Thursday.

TWO WEEKS IN JAIL! What's the crime?

It has now been two weeks since David and Danae were sent to jail for standing up for their (and our) first amendment rights. Conditions are not great in the jails where they are being kept. David has been put in solitary confinement multiple times (mostly to punish him when there have been support rallies outside) and Danae is feeling sick and malnourished.

Please help raise money for their support and defense.

Two San Diego Organizers Jailed for Resisting the Grand Jury

8pm(PST) - A rally and vigil for David and Danae started at the Federal courthouse at 8pm, and soon after moved to the Federal Prison down the street. With chants of "Civil Rights are under attack, what do we do? Act Up, Fight Back!" and "Freedom Now!" the 35 demonstrators got responses both from the prisonsers inside (who banged on the windows) and the guards outside (who threatened to arrest anyone on Federal Property). The activists liken the grand jury to a witch-hunt where no actual crime is being investigated, but people are targeted for their beliefs and associations. In this case those subpoenaed believe they are being forced to testify in front of the grand jury simply for attending a public meeting in August of 2003. The secretive nature of a grand jury makes it very difficult for anyone to learn what is the subject of the investigation. People who are served subpoenas must testify and may have no lawyer present during the questioning.

Judge to Hear First Amendment Objections

Today, myself, Danae and David Agranoff went into the Grand Jury room and refused to answer questions based on our First Amendment rights to free association and right to privacy.

We were then sent to see Judge Gonzalez at 4:15pm. The prosecution made the request that the hearings be sealed, so only one witness at a time spoke to the judge. In the courtroom were the two prosecutors, our lawyers, Danae, myself and David, and about 10 FBI agents. Myself, Danae and our lawyers were asked to leave while the judge heard Jeremy Warren's motions.

My Visit from the FBI and ATF

On June 8, 2005 I was visited by agents of the FBI and ATF and questioned about the University Towne Centre fire of July 31, 2003 and the speech by animal-rights and environmental activist Rod Coronado in Hillcrest on August 1, 2003. That appearance has already led to early-morning raids on two other San Diego activists whose videotapes of the event were seized by the FBI, and Coronado's return to Southern California in May 2004 was met by even more intense repression. This time the FBI and ATF seemed interested mostly in obtaining photos of the audience at the Coronado event so they could scan them for "persons of interest" in the UTC arson investigation.
