My name is Nathaniel D. Archer, and I reside in San Francisco, Ca. I am registered with the State of California as a Medical Cannabis patient. I recently had all of my equipment and garden confiscated by the County of San Diego and was charged with cultivation. I was incarcerated despite the fact that I have documentation to support my patient status.

I have a court appointed Attorney, who has an agenda similar to that of the County of San Diego; to put myself and other advocates of Medicinal Cannabis behind bars, solely because of their denial of the existence of Medical Cannabis. I was told by my appointed counsel, outside of the courtroom, that I would be serving six to ten years in State Penitentiary. My alternative was to accept an offer from the court to serve three years probation with no jail time and I would get a strike and under duress, remiss my fourth amendment right.

I asked the court to dismiss my appointed counsel on the grounds that he is biased for the court and prejudiced against me. I was denied and then rushed to my readiness trial without any consultation, or time to plan for my defense. My now disgruntled counsel is attempting to dismiss the medical documentation from my case which will leave me with out defense.

Actions like this support the county’s effort to overturn the Medical Cannabis community and support their agenda against the State. I was incarcerated despite my patient status under Proposition Two Fifteen (215) and my exemption to Senate Bill Four Twenty (420), which gives me the right to grow more than the guidelines provided by SB 420. During an out-of-the-courtroom conversation with a Court- Appointed Attorney, I was threatened with jail time based on inaccurate information from my record.

Because I cannot afford an adequate defense attorney, I must accept between Six to Ten years in prison for an alleged "crime" against the state; Alternatively, I must (under duress) accept a “strike” and the remittal of my fourth amendment right. This will place friends, family and even innocent bystanders at risk of inappropriate searches or unlawful incarceration simply because of my presence.

All these court appearances have seriously crippled me financially as well. After Sixty-six hundred dollars in bail costs, my loss of time at work and repeated trips from San Francisco to San Diego and back, I am exhausted of my finances. At this pace I will soon be dependant on my friends and family for support.

My next court appearance is in San Diego County on April Sixth, Two Thousand Seven, therefore; I am writing this letter to reach out for help, hoping for someone who is compassionate and altruistic towards the Medical Cannabis community. Since I was 17 I have suffered impaired movement from multiple accidents to my right knee not to mention the pain that accompanies it. Western Medication has never been as effective for me as Medicinal Marijuana. I began to cultivate my first medical garden in 1998 and found relief not only in the product of the plant but the act of gardening was very thereputic. Since then I have suffered many losses from gardens/equipment being stolen to confiscation and detainment for my growing medicinal marijuana. I have put so much effort into helping others for the past two years that I learned many things and gained many contacts. One thing I have learned is that no matter what there is nothing that you "can't do". Another is that all things are possible.

I have been threatened with 6-10 years incarceration for for growing my medicinal garden and caregiving for others. I have helped many people to find relief by providing medical marijuana plants or herbs. I know that medical marijuana is effective and doesn't impair your abilities, like conventional "Drugs". I will hold on to that fact until the end of my court case, as a comfort and reassurance.

Today, I am living in San Francisco and getting a lot of support here, but will I go free in San Diego? I say Yes! I have not broken any laws and am within my rights. The people I was caregiving for are allowing of my disclosing their information so a little more heat is taken off me. I have recieved many emails of support and encouragement and several with assistance as well. If I tried to do this on my own I would have been lost and probably taken a deal.

I hope that I can set an example for all medical marijuana patients with my case. Don't let them influance you into taking a deal when you are not in any violation. Be strong and steadfast in your ways, do not worry about the threats know your rights. I will be contacting the ACLU since I was incarcerated and encourage others to do the same. Don't let our rights be descimated anylonger. Stand up for yourself but also the rights of others. We are the majority and have great power but there is no power if we don't unite. You know " United we stand, devided we fall...." Well let us unite!!!

Contact P.A.N., A.S.A., Normal or join one of the support groups in your area, sign up for newsletter. Be involved and speak out, contact your elected officials to let them know how you feel. Write a letter to one of the unfortunate medical marijuana patients already incarcerated. Activists can direct you to several. No one deserves to be left alone. Don't assume someone else will do it, it takes all of us not one of us.
Please get involved at some level your invlovement is very important.
